Michael fractured his leg and ankle in the accident
A former North Warwickshire Borough Council leader who fractured his leg and ankle when he was hit by a car has secured £28,000, with support from Unite Legal Services and Thompsons Solicitors.
Michael Stanley, 68, was crossing a road in Nuneaton one night in November 2014 when he was hit by a car.
Due to the severity of his injuries, he spent two weeks in hospital. After two operations to repair fractures to his right leg and ankle, Michael was fitted with a plaster cast and ordered not to put any weight on his leg for three months. He then needed crutches for two months and had to wear an orthopaedic boot. It took 18 months for his leg to heal.
Michael was the leader of the council when the accident happened and was unable to carry out many of his pre-accident duties, including campaigning for an upcoming election.
As he had been a Unite member since 1966, he turned to Unite Legal Services before contacting Thompsons Solicitors for free legal guidance.
"I became a Unite member in my teens and never looked back," he said. "This claim has reminded me why I joined decades ago. Without my union’s legal support, I would not have received the compensation I did.
"The driver was going the right way but unfortunately wasn’t paying attention to his surroundings, plain and simple. If he had, I wouldn’t have been hospitalised. The injury curtailed my council work at one of the most important times of the year and left me in significant pain months after the elections ended."
Michael continues to suffer occasional discomfort and feels the injury has affected his day-to-day life.
"The fractures has definitely slowed me down," he said. "I find myself trailing behind family and friends when I’m out walking and general housework can be a chore."
Peter Coulson, Unite regional officer, said: "A Unite membership provides a wide range of legal support. It’s not just about helping those injured at work, as this case clearly shows. Michael’s council activities were almost brought to a halt because of his injuries in an accident that shouldn’t have happened.
"We’re glad we were able to work with Thompsons Solicitors to bring a successful resolution to the case, making sure Michael was fairly compensated for his injuries."
